These Terms & Conditions (“Terms”) govern your access to and use of the websites, online stores, applications, devices, and services offered by myWaves Technologies Limited (“myWaves”, “we”, “us”, or “our”) (collectively, the “Services”). By accessing or using the Services, creating an account, or purchasing a product, you agree to be bound by these Terms and by our Privacy Policy and Security Policy. If you do not agree, please do not use the Services.
You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Services or make a purchase. By using the Services, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
Subject to these Terms, myWaves grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use. All rights not expressly granted are reserved by myWaves.
Shipping timeframes, returns, and refunds are handled in accordance with the policies presented at the point of sale in our online store. Where required by law, statutory cancellation and refund rights apply in addition to any policy we offer.
The Services, including all text, graphics, logos, software, audio, the myWaves name and brand, and the proprietary neuro-acoustic transduction technology, are owned by or licensed to myWaves and are protected by intellectual-property laws. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from any part of the Services except as expressly permitted by us or by law.
myWaves products and Services are designed to support relaxation, sleep, and general wellbeing. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The Services do not provide medical advice and are not a substitute for professional healthcare. Always consult a qualified healthcare provider with any questions about a medical condition, before making changes to your sleep or health routine, or if you have a neurological condition, a pacemaker or other implanted device, or are pregnant. If you experience discomfort while using a myWaves device, discontinue use.
You agree not to:
The Services may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, myWaves and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence.
You agree to indemnify and hold harmless myWaves from any claims, damages, liabilities, and expenses arising out of your misuse of the Services or your breach of these Terms.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
We may modify the Services or these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date and, where appropriate, communicated to you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
We may suspend or terminate your access to the Services at any time if you breach these Terms or where necessary to protect the Services or other users. Provisions that by their nature should survive termination will continue to apply.
These Terms are governed by the laws of the jurisdiction in which myWaves Technologies Limited is incorporated, without regard to its conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where applicable consumer-protection law grants you the right to bring proceedings in your place of residence.
